Vietnam's work permit regulations have been updated for 2026, introducing several changes that affect foreign employees and their employers. These updates aim to balance the need to attract foreign talent with the protection of the local labor market.

The most significant change is the introduction of new exemption categories. Certain high-level executives, specialists, and technical workers may now qualify for work permit exemptions if they meet specific criteria related to their qualifications and the nature of their employment.

For foreign employees who require work permits, the application process has been streamlined. Employers can now submit applications through an online portal, reducing processing times and improving transparency. The standard processing time has been reduced from 7 business days to 5 business days.

Documentation requirements remain rigorous. Applicants must provide proof of their qualifications, relevant work experience, health certificates, and a clean criminal record. All foreign documents must be legalized and translated into Vietnamese by certified translators.

Employers should note that the penalties for employing foreign workers without valid work permits have been increased substantially. We recommend that companies conduct an audit of their foreign workforce to ensure full compliance with the updated regulations.
